Recovery for Occupants in Florida Car Crashes
Injured Passenger in a Car Accident
As the passenger in a vehicle, you may initially feel at a loss about your rights to recovery after a car accident. To which insurance company do you file your claim? Who is responsible for paying your medical bills, lost wages, disability and other damages? What if your loved one who was driving the vehicle is to blame for your injuries?
Fowkes & Hasanbasic, Accident and Insurance Lawyers answers these questions and helps you pursue your rights. Our law firm concentrates on car, motorcycle and truck accident recovery and we regularly represent injured passengers. With a background in insurance defense, our passenger accident lawyers have insight into effective paths to recovery.
Personal Injury Protection Coverage of Passengers
Florida’s no-fault insurance laws require vehicle owners to carry Personal Injury Protection (PIP), which covers the policyholder and certain other people, regardless of who was to blame for the accident. Each driver must have a PIP policy for at least the minimum $10,000 minus the deductible. The policy pays 80 percent of medical expenses arising from the auto crash, 60 percent of the crash-related lost wages and $5,000 for accident fatalities. The vehicle owner can pay additional premiums to increase the amount of PIP coverage.
PIP covers your passengers who are injured in your car and who do not own a vehicle. Passengers who own their own vehicles are responsible for their own insurance recovery under their PIP policies.
Suing the At-Fault Driver
Considering skyrocketing medical costs, you can quickly reach your maximum PIP limit if you are involved in a serious accident. You may consider consulting with a top car wreck lawyer and suing the at-fault driver and his or her insurance company for damages you incur above your PIP policy limit.
We recognize that the person responsible for your injuries may be a family member or a dear friend. Our attorneys explain the process of recovery and insurance negotiations to ease your mind about pursuing the damages you need and are entitled to.
Uninsured Motorists Accidents that Injure Passengers
Hit By Uninsured Driver in Florida
Florida has the second highest rate of uninsured motorists in the nation, equal to almost one-fourth of drivers in the state. You have a good chance, therefore, of being injured by an uninsured driver. Of those who are insured, many Florida drivers carry only the minimum insurance required by law. Uninsured motorist and underinsured motorist (UM/UIM) policies cover the amount of damages you sustain above your PIP when recovery is unlikely from the at-fault driver.
