Florida’s Turn Right on Red Laws
Florida law allows drivers to turn right on red. The driver is supposed to come to a complete stop, look for traffic and only turn if doing so is safe. However, drivers often carelessly roll through the stop sign or traffic signal. This dangerous action results in hundreds of accidents on Florida roadways.
Whether the driver was careful is a matter of discretion. Under Florida Statutes section 316.0083, drivers may not be cited for turning right on red in most cases:
A notice of violation and a traffic citation may not be issued for failure to stop at a red light if the driver is making a right-hand turn in a careful and prudent manner at an intersection where right-hand turns are permissible. A notice of violation and a traffic citation may not be issued under this section if the driver of the vehicle came to a complete stop after crossing the stop line and before turning right if permissible at a red light, but failed to stop before crossing over the stop line or other point at which a stop is required.

For instance, a construction company must determine that its equipment and barriers do not create a traffic safety hazard. If the project dictates that the obstructions must be placed in an unsafe position, the company is responsible for employing flagmen to direct traffic.
